(The above sheet is largely based on a halachah write-up written by Halachically Speaking and a Teshuvah written by R’ Yom Tov Sanger in his Shu”t Madanay Yom Tov 2:46) Divrei Torah for the Shabbos Table You Hear What You Want to Hear Towards the beginning of this week’s parsha, Balak sends representatives to invite Bila’am to curse the Jews. The list includes, not marrying two wives; not divorcing one’s wife against her will; not embarrassing ba’alay teshuva; and many more, this week will focus on the seventh and probably most famous cherem in the list which is: ‫חרם‬ ‫“ – שלא לראות בכתב חבירו שלא ברשותו אלא אם כן זרקו‬A cherem not to read other people’s letters without permission, unless it is thrown away.” ‫פגי"ן דרגמ"ה‬ Some say (see Shu”t Chikakei Lev, Yoreh Deah 49) that the cherem only applies if one writes on the letter, “pey gimmel yud nun daled reish gimel mem hey (‫”)פגי"ן דרגמ"ה‬, which is an abbreviation of the pasuk (Koheles 10:8), ‫פרץ גדר ישכנו נחש‬, and the name of Rabbeinu Gershom Meor HaGolah. In the poskim we find at least three different approaches: 1) The Halachos Ketanos (1:276) maintains that the reason for the cherem of not reading someone else’s letter is based on the halachah of rechilus - the halachah which forbids one to reveal gossip or a secret. Thrown Out Letter / Ripped Up Letter The Shevet HaKehosi (1:315:1) speaks out, that when the poskim say one is allowed to read a letter thrown into the garbage, they are referring to an open place where one can tell that the one who threw it there does not care if anyone reads it. Furthermore, a public figure may be dealt in a different way than an ordinary person and if the letter is something that one can learn Torah from (i.e., a collection of Teshuvos) then it may be permitted since it will not be hurting the individual who wrote them. If Rabbeinu Gershom intended to forbid listening to another person’s phone conversation, he should have written that it is forbidden to listen in to two people talking to each other (which at the time was equivalent), from the fact that he
