The Shulchan Aruch (Yoreh De’ah 262:1) rules accordingly: ‫ אין מלין עד שתנץ החמה ביום השמיני ללידתו וכל היום כשר למילה‬- “We do not perform bris milah until the sun rises on the eighth day after his birth; the entire day is valid for fulfilling the mitzvah of milah.” However, in many cases the bris is not performed on the eighth day, rather it is performed later on after eight days. This halachah, whose source is a Gemara in Yevamos (71a), is ruled by the Shulchan Aruch (262:2): ‫ חולה אין מלין אותו עד שיבריא וממתינים לו מעת שנתרפא מחליו שבעה ימים מעת לעת ואז מלין אותו‬- “We do not perform bris milah on a sick baby until he recovers, and seven full days have passed from the time of his recovery until the bris is performed.” The Rambam (Hilchos Milah 1:18) explains, that we don’t perform a bris on a sick baby, as a bris can be performed later, however, a life cannot be brought back. 1 The principle established by the Noda B’Yehuda whereby “each day is the time for the bris,” and it is therefore forbidden to delay the bris without medical need, is echoed by the wording of the Rambam (Hilchos Milah 1:2): ‫כשיגדל‬ ‫ הוא חיב למול את עצמו וכל יום ויום שיעבר עליו משיגדל ולא ימול את עצמו הרי הוא מבטל מצות עשה‬- “When he grows up he must perform bris milah on himself, and for each day that passes after he has grown up without performing bris milah, he is in transgression of a positive mitzvah.” The Rambam continues: ‫“ – אבל אינו חיב כרת עד שימות והוא ערל במזיד‬However, one doesn’t get punished with kores unless he dies without performing a bris milah intentionally.” The Ra’avad argues and writes that the punishment of kores applies for every day of a person’s failure to perform a bris milah upon himself.
