Rabbi Immanuel Bernstein 2023 / 5783 Pshuto PSHUTOShel Mikra SHEL MIKRA From the Teachings of Rav Yehuda Copperman zt”l Parshat Va’etchanan Bal Tosif — The Prohibition of Adding On to the Torah ‫ֹלא תֹ סִ פּו עַ ל הַ ָדּבָ ר אֲשֶ ׁר ָאנֹ כִ י מְ צַ וֶ ּה אֶ תְ כֶם‬ You shall not add to the word that I command you (Devarim 4:2) Our parsha introduces us to the prohibition of Bal Tosif — of adding on to mitzvot. For in the beginning (of that pasuk) it says, “‫שְ ׁמַ ע אֶ ל הַ חֻ קִּ ים וְ אֶ ל הַ מִּ שְ ׁפּ ָ טִ ים‬ ‫ — אֲ שֶ ׁר ָאנ ֹכִ י מְ לַ מּ ֵ ד אֶ תְ כֶ ם לַ עֲ ׂשו ֹת‬Heed the statutes and laws that I am commanding you to do,” and in that regard it proceeds to state “‫ֹלא ת ֹסִ פּו עַ ל הַ דּ ָ בָ ר אֲ שֶ ׁר ָאנ ֹכִ י מְ צַ וּ ֶ ה‬ ‫ — אֶ תְ כֶ ם‬You shall not add on to the matter4 that I am commanding you.” In this Parsha,5 it refers to “‫ — כָ ּל הַדּ ָבָר‬the entire matter,” and thus it is here that Chazal expounded that one may not add anything on to the mitzvah itself. In his She’eilot U’Teshuvot Reishit Bikkurim (siman 7), he writes: It appears to me that in truth we need to explain why the prohibition of Bal Tosif is written in Parshat Va’Etchanan in the plural (“‫)”ֹלא ת ֹסִ פּו‬, while in Parshat Re’eh it is repeated, but written in the singular (“‫)”ֹלא ת ֹסֵ ף‬. However, the Ramban, in his peirush to our pasuk, suggests an additional way of understanding this prohibition: In my opinion, even if one decided to fabricate something as an independent mitzvah, for example, if he introduced a new chag in a different month to the Chagim of the Torah, as did Yeravam,2 he has violated this prohibition. The Vilna Gaon: Two Parshiyot within Bal Tosif The Vilna Gaon illuminates the entire sugya of Bal Tosif by demonstrating how the two types of Bal Tosif [adding a detail to a mitzvah and adding a mitzvah to Taryag] are reflected in the two places in the Torah where the prohibition is mentioned. 3 Actually, although this second type of Bal Tosif is not referred to by Chazal in the Gemara or collections of midrash halachah, it is found in the Midrash Pesikta Zutrata to this pasuk: “You shall not add on to the mitzvah that I am commanding you … for example, the festival that Yeravam invented in
