The prophet Isaiah says, “For My thoughts are not your thoughts, nor are your ways My ways, says G-d.” Had we been asked what would constitute justice, we might have said, “pay back what he stole so it’s back to the way it was.” However, though the one it was stolen from would be made whole, the thief would be no worse off than he was before and not have experienced the loss he wished to cause, and thus would have no expiation for his sin. They knew it was not for selling Yoseph, for they had convened a legal court and followed the law in their decision, but “We are guilty for not hearing the cries of our brother.” Part of being a Jew is that when the law is on your side, that doesn’t mean you stand your ground and demand. (Plus, he might try again and hope not to get caught this time.) Only Hashem in His infinite wisdom and understanding can teach us what true justice is, and by learning from His Torah, we can begin to gain some insight into the world from His perspective. Eventually, though, if he does not make amends for his sins, a person will be punished as he deserves.” We find two distinct situations in Mishpatim that discuss G-d’s hearing the cries of the downtrodden. If the borrower is poor and uses his blanket for collateral, for example, the lender is directed to bring it back to the borrower to use for the night, and then get it again in the morning. But when the borrower cries out and you have no mercy; when you can hear his cries and be unmoved, then says G-d, I will surely see that and hear his cries because I am compassionate. The very first one in Parshas Mishpatim is that of the Eved Ivri, the Jewish slave who was sold into servitude for having stolen and he did not have the wherewithal to repay it. The very poignant lesson is that the Torah’s judgments are a not a way to identify bad people, but a way to ensure that the good inside people is allowed to shine forth.
