(R’ Ozer Alport) Honest to Goodness ‫אלא הדברים אשר דבר משה אל כל ישראל בעבר הירדן במדבר בערבה מול סוף בין פארן ובין תופל ולבן וחצרת‬ ‫ודי זהב‬ “These are the words that Moshe spoke to all Yisroel, across the Yarden, in the wilderness, in the Plain, opposite the Sea of Reeds, between Paran and between Tophel and Lavan, and Chatzeiros and Di-Zahav.” (Devorim 1:1) The Medrash (Devarim Rabbah 1:5) tells us that only Moshe was in a position to rebuke Bnei Yisroel. (Peninim on the Torah) A Vort for Shabbos Chazon .‫דרכי ציון אבלות מבלי באי מועד כל שעריה שוממין כהניה נאנחים בתולתיה נוגות והיא מר לה‬ “Tzion’s roads are in mourning, empty of festival pilgrims; All her gates are deserted, Her priests sigh, Her maidens are unhappy— She is utterly disconsolate!” (Eichah 1:4). Rabbi Zvi Hirsch Ferber explains this pasuk based on a Gemara in Berachos (35b): ‫ דורות‬.‫ בא וראה שלא כדורות הראשונים דורות האחרונים‬:‫ואמר רבה בר בר חנה אמר רבי יוחנן משום רבי יהודה ברבי אלעאי‬ ,‫ דרך חצרות‬,‫ דורות האחרונים מכניסין פירותיהן דרך גגות‬,‫הראשונים היו מכניסין פירותיהן דרך טרקסמון כדי לחייבן במעשר‬ ‫ בערתי הקדש‬:‫ שנאמר‬,‫ אין הטבל מתחייב במעשר עד שיראה פני הבית‬:‫ דאמר רבי ינאי‬.‫ כדי לפטרן מן המעשר‬,‫דרך קרפיפות‬ .‫מן הבית‬ The Gemara there contrasts the earlier and later generations. Rav Ferber explains that ‫“ – כל שעריה שוממין‬all Her gates are deserted” is a reference to this practice of the later generations, of bringing their produce in ‘through the back-door’ as a ‘tax avoidance measure’ to save themselves from having to separate terumos and ma’asros. Since many catastrophes and national tragedies befell Klal Yisroel during this time period, including the destruction of both the first and second Beis HaMikdosh on Tisha B’Av, halachah dictates various restrictions on us in order to mourn our great losses, and properly commemorate by feeling the devastation.
