Someone who commits a sin and is punished with skilah [stoning] by Beis Din is hanged after being put to death (according to Rabbi Eliezer anyone who is punished with stoning is hanged, while Chachomim opine that only a blasphemer and idolater is hanged after skilah), however, we are warned: '‫קבר תקברנו ביום ההוא כי קללת אלקים תלוי ולא תטמא את אדמתך אשר ה‬ ‫ אלקיך נתן לך נחלה‬- “But you shall not leave his body on the pole overnight. Rav Choma was silent and said nothing to him because he would not have understood that the mitzvah of earth burial, as opposed to placing him in a box, is derived from the doubled verb: ‫ קבר תקברנו‬- “you shall surely bury him”, and it is not merely a stylistic choice but the source of a new halachah. Eretz Yisroel The Ramban (Devorim 21:22) mentions an additional issur in leaving the deceased unburied in Eretz Yisroel: ‫ולא תטמא את אדמתך‬ ‫ אשר ה' אלקיך נתן לך נחלה‬- “…and you shall not defile your land, which Hashem, your G-d, is giving you as an inheritance.” In his opinion, leaving the deceased without burial in Eretz Yisroel comprises three transgressions — two lo saseh’s, and one aseh. The Tzava’ah of Rav Yehudah Hachossid In his tzava’ah, Rav Yehudah Hachossid prohibits many things, here are some of them: A man should not marry a woman who has the same name as his mother, nor should he marry a woman whose father has the same name that he has. Rav Shneur Zalman of Liadi (author of Shulchan Aruch HoRav and Tanya) is quoted as having said that to understand one of Rav Yehudah Hachossid’s statements in his tzava’ah would require a work the size of the Shelah (a classic of halachah, kabbalah and mussar that is hundreds of pages long).
