When enumerating the mitzvos at the begin- ‫ ִאין ִמִ ְנְַיַ ן ַה �ִּמִ ְצְ ֹוֹ ת ְּבְ � ֵר ׁיׁש ֵסֶפֶ ר ַהַּי� ד‬.‫א‬ ning of the Mishneh Torah (and similarly, in his )‫(ְוְ ַעל ֶּד�ֶ ֶר ְךְ ֶזֶ ה ִאין ַזַ ְיְ ין ֵסֶפֶ ר ַה �ִּמִ ְצְ ֹוֹ ת‬ ְֶ Sefer HaMitzvos), Rambam lists as the final posi- ‫ ַאְלְ ס ִדי ֶלעְצֶטע‬,‫ְׁש� ְ ַרְיְ יְּבְ � ט ֶדער ַר ְמְ ַּב� "ם‬ tive commandment the charge “to judge the laws ‫ ָלָ דּוּן ְּבְ � ִדיֵנֵ י ְנְ ָחלֹוֹ ת‬:‫ִמִ ְצְ ַוַ ת ֲעֵׂש�ֵ ה‬ concerning inheritance, as it is written,1 ‘When a .ֹ‫ֶׁש� ֶ ֶּנֶ � ֱא ַמַ רא ִא ׁיׁש ִּכִ� י ָיָ מּוּ ת ּוֵּבֵ ן ֵאין לֹו‬ man dies without a son….’ ” ‫ ַאז ֶדער ֵסֶדר ִאין ַרְמְ ַּבַ � "ם‬, ַ‫ְס'ִאִ יז ָיָ דּוַּע‬ It is well known that Rambam structured his ‫ ְוְ ַעל �ִּפִ י ֶזֶ ה ִאיז‬.‫ִאיז ְמְ דּוָּיָ יק ְּב� ַתְכְִלִ יתב‬ work in extremely precise order.2 Thus, it can be ‫ ַאז ָד אס וָוָ אס ֶדער ַרְמְ ַּבַ � "ם ִאיז‬,‫מּוָּבָ ן‬ presumed that the placement of the command- )‫ְמְ ַד �ֵּייק צּוּ ְמְ ַס �ֵּיים ַזַ ְיְ ין ִדי ִמִ ְצְ ֹוֹ ת (ֲעֲ ֵׂש�ֵ ה‬ ment concerning the laws of inheritance as the ‫ ִאיז‬,"‫ִמִ יט ֶדער ִמִ ְצְ ָוָ ה פּוּן "ְנְ ָחלֹוֹ ת‬ final positive commandment was deliberate, in- ‫וַוַ ְיְ ילג ִדי ִמִ ְצְ ָוָ ה ִאיז ֶדער ְגְ ַמַ ר ּוְּׁש� ְ ֵלֵ ימּוּ ת‬ dicating3 that these laws embody the most apt .‫פּוּן ִעְנְַיַ ן ַה �ִּמִ ְצְ ֹוֹ ת‬ conclusion to the positive commandments. ‫ּוְּכְֵׁש� ֵ ם וִוִ י ִדי ִמִ ְצְ ָוָ ה ִראׁשׁ ֹוֹ ָנָ ה ִאין ִמִ ְנְַיַ ן‬ Similar logic applies to Rambam’s choice of the ‫ַה �ִּמִ ְצְ ֹוֹ ת – "ֵלֵ יַדַ ע ֶׁש� ֶ ֵּי� ׁׁש ָׁש� ָ ם ֱאלֹוֹ ַק ה‬ first positive commandment, “to know that there ‫ֶׁש� ֶ ֶּנֶ � ֱא ַמַ רד ָא ֹנִֹכִ י ה' ֱאֹלֶֹקיָךָ " – ִאיז ֶדער‬ is a G-d, as it is written,4 ‘I am G-d your L-rd.’ ” ‫ וַוַ ְיְ יל‬,‫ַטַע ם ֶדעְרְ פּוּן מּוָּבָ ן ְּב� ַפַ ְׁש� ְ טּוּ ת‬ The reason for that choice is obvious: It is the first ‫ָד אס ִאיז ִדי ֶעְרְׁש� ְ ֶטע אּוּן ִעיָקָ ר'ִדִ יֶקֶ ע‬ and the most fundamental of all the mitzvos that ‫ִמִ ְצְ ָוָ ה פּוּן ַאֶלֶ ע ִמִ ְצְ ות ַה ָּבָ � אֹוֹ ת ְלְ ַ
